How to determine AMSR

Use the strongest available evidence and document the method.

Equivalent worker

Start with an Australian employee doing equivalent full-time work at the same workplace and location.

Industrial instrument

Check any applicable award, enterprise agreement or other industrial instrument.

Market evidence

Where needed, use comparable job ads, Jobs and Skills Australia data, remuneration surveys or industry advice.

Guaranteed earnings review

Separate base salary and guaranteed monetary earnings from benefits that cannot be counted toward the relevant threshold.

  • Base salary and guaranteed monetary allowances may be relevant.
  • Non-monetary benefits are excluded from the threshold comparison.
  • Variable overtime, bonuses or commissions need careful treatment.
  • The contract, nomination and payroll setup should use consistent figures.
  • Review salary changes before lodgement and throughout sponsored employment.

Common salary risks

  • Using the threshold as the market salary without market evidence.
  • Comparing a junior sponsored role with a senior equivalent worker.
  • Counting a vehicle, accommodation or other non-monetary benefit.
  • Using advertisements from a different occupation, region or experience level.
  • Contract, nomination and payroll figures that do not match.
